Unless otherwise set forth in these Terms of Service, the following terms have the following meanings:

Welcome to Artist Roster (“we,” “our,” or “us”). By using our website, mobile applications, messaging services, or any related services (collectively, the “Services”), you agree to these Terms and Conditions (“Terms”). Please read them carefully. If you do not agree, you may not use the Services.
By registering, you also agree to keep your information up-to-date. Inaccurate or outdated information can lead to issues with your account and may affect your ability to use certain features of Artist Roster.

1. Eligibility
- You must be at least 18 years old to use Artist Roster.
- By using Artist Roster, you represent and warrant that you meet these requirements.
2. Services Provided
- Artist Roster provides a platform for artists to showcase their work, build a professional profile, and increase visibility with buyers, curators, gallerists, organizations, and peers. The platform includes artist profiles, portfolio management, search and matching tools, and discovery features.
- Our tools and resources are designed to help artists gain exposure and connect with opportunities in the art world. They do not constitute financial, legal, or professional career advice.
3. AI-Generated Art Policy
Artist Roster is a curated marketplace for original artwork created by human artists. The platform exists to connect collectors and buyers with artists whose work reflects genuine creative skill, vision, and practice. To protect the integrity of the marketplace and the value of our artists' work, Artist Roster does not permit AI-generated artwork to be listed, displayed, or sold on the platform.
4. AI Content Definitions
4.1 “AI-Generated Content”
AI-Generated Content refers to any image, artwork, or visual work where the primary creative output — the composition, rendering, form, or visual substance of the work — was produced by an artificial intelligence system, generative model, or automated process. This includes but is not limited to works created using:
- Text-to-image generators (e.g., Midjourney, DALL·E, Stable Diffusion, Firefly, or equivalent tools)
- Image-to-image generators where AI substantially transforms a source image into a new composition
- AI-based style transfer tools that generate a new work by applying learned artistic styles to input content
- Any tool or workflow where the artist's role is primarily that of a prompter, curator, or selector of machine-generated output rather than the direct creator of the visual work
A work is considered AI-Generated if AI was responsible for the substantive creative decisions — the arrangement, form, detail, and visual character of the final piece — regardless of how much human selection, curation, post-processing, or editing was applied after generation.
4.2 “AI-Assisted Work” (Permitted)
Artist Roster recognizes that many contemporary artists incorporate digital tools — including AI-powered tools — into their creative practice without those tools becoming the author of the work. The following uses of AI are permitted, provided the artist remains the primary creative author of the final work:
- Reference and ideation — Using AI to generate reference images, mood boards, color palettes, or compositional sketches that inform but do not constitute the final work
- Technical assistance — Using AI for background removal, image upscaling, noise reduction, color correction, or other post-production tasks that enhance a human-created work without replacing the creative content
- Process tools — Using AI-powered features within creative software (e.g., content-aware fill, automated masking, smart selection tools) as part of a broader human-directed creative process
- Cataloging and metadata — Artist Roster itself uses AI to suggest metadata tags for uploaded artwork; this does not affect the status of the artwork
The key distinction: In AI-Assisted work, the artist made the creative decisions and executed the work. AI served as a tool in service of the artist's vision. In AI-Generated work, the AI system made the substantive creative decisions, and the human's role was limited to prompting, selecting, or curating output.
4.3 Gray Areas and Judgment Calls
Some creative workflows exist in a gray area between AI-Generated and AI-Assisted. Where a question arises, Artist Roster will consider the following factors:
- (a) Creative authorship — Did the artist make the core visual and compositional decisions, or did the AI?
- (b) Degree of transformation — How substantially did the artist alter, build upon, or depart from any AI-generated starting point?
- (c) Skill and craft — Does the final work reflect technical skill, artistic training, or a sustained creative practice?
- (d) Transparency — Has the artist been forthcoming about their process and tools?
Artist Roster reserves the right to make final determinations on a case-by-case basis. Decisions will be made in good faith, with the goal of maintaining a marketplace that collectors and buyers can trust.
5. Artist Representations and Warranties
By uploading artwork to Artist Roster, you represent and warrant that:
- (a) The work is your original creation and reflects your own creative authorship.
- (b) The work is not AI-Generated Content as defined in Section 4.1 above.
- (c) If you used AI-powered tools in your process (as described in Section 4.2), you are the primary creative author of the final work, and the AI tools served an assistive role.
- (d) You will accurately and honestly describe your creative process if asked by Artist Roster's review team.
- (e) You understand that misrepresenting AI-Generated Content as original human-created work constitutes a material breach of these Terms.
6. Enforcement
6.1 Review and Investigation
Artist Roster reviews all artist applications and may review individual artworks at any time. The review team may consider portfolio consistency, artistic process, community reports, publicly available information, and any other relevant factors when evaluating whether work complies with this policy. Artist Roster is not obligated to disclose its specific review methods or criteria.
6.2 Actions
If Artist Roster determines, in its sole discretion, that an artist has uploaded AI-Generated Content in violation of this policy, Artist Roster may take one or more of the following actions:
- (a) Removal — Remove the offending artwork from the platform.
- (b) Account suspension — Temporarily suspend the artist's account pending further review.
- (c) Account termination — Permanently terminate the artist's account and remove all listed works.
- (d) Transaction reversal — Reverse or refund any transactions involving AI-Generated Content, at the artist's expense.
- (e) Community notification — In cases of deliberate misrepresentation, Artist Roster reserves the right to notify affected buyers.
6.3 Appeals
An artist whose work has been removed or whose account has been suspended may appeal the decision by contacting Artist Roster's support team within thirty (30) days of the action. Appeals should include any relevant documentation of the artist's creative process (e.g., progress photos, video recordings, sketches, or process documentation). Artist Roster will review appeals in good faith and respond within a reasonable timeframe.
7. Community Reporting
Artist Roster encourages its community to report suspected AI-Generated Content through the platform's reporting tools. Reports will be reviewed by the Artist Roster team. Submitting a report in good faith will not result in any negative action against the reporting user. False or malicious reports intended to harm another artist may result in action against the reporting account.
8. AI Policy Evolution
The relationship between AI tools and creative practice is evolving rapidly. Artist Roster reserves the right to update this policy as technology, community standards, and the art market develop. Material changes to this policy will be communicated to artists via email and will take effect thirty (30) days after notice, unless a shorter period is required by circumstances (e.g., a new category of AI tool that poses an immediate integrity risk to the marketplace).
Artist Roster is committed to engaging with its artist community on these questions and welcomes feedback on the boundaries and application of this policy.
9. User Content & Intellectual Property Rights
- You retain full ownership of all artwork, images, text, and other content you add to Artist Roster (“User Content”), whether through direct upload, the Import from Website feature, bulk import, or any other method provided by the Services. By adding User Content, you grant us a non-exclusive, worldwide, royalty-free license to display, distribute, and promote your User Content within and in connection with the Services.
- You represent and warrant that you own or have the necessary rights to all User Content you add to Artist Roster, regardless of the method used to add it. You further represent that your User Content does not infringe on the intellectual property rights, copyrights, trademarks, rights of publicity, or other proprietary rights of any third party.
- The availability of tools that facilitate adding content to Artist Roster — including the ability to import content from external URLs — does not imply that you have the right to import or use any particular content. You are solely responsible for ensuring you have the legal right to use all content you add to your profile.
- You may remove your User Content from Artist Roster at any time. Upon removal or account deletion, we will cease displaying your User Content, though cached or archived copies may persist for a limited time.
10. Import from Website Feature
Artist Roster provides an Import from Website feature that allows you to import content from external websites by providing a URL. By using this feature, you acknowledge and agree to the following:
- (a) Ownership responsibility — You confirm that you own or have the necessary rights to all content being imported. You are responsible for ensuring that any images, text, or other materials imported to your Artist Roster profile do not infringe on the intellectual property rights of others.
- (b) Third-party terms — You are solely responsible for compliance with the terms of service, usage policies, and applicable laws governing the third-party website from which you are importing content. Artist Roster does not review, monitor, or guarantee compliance with third-party terms on your behalf.
- (c) No endorsement or verification — The ability to import content from a URL does not constitute Artist Roster's endorsement, verification, or validation of your rights to that content. Artist Roster does not verify ownership or licensing of imported content.
- (d) Content review — You are responsible for reviewing all content retrieved by the import tool before adding it to your profile. The import tool may retrieve images, text, or other materials from the provided URL that you do not own or do not wish to include. You must deselect or remove any content you do not have the right to use.
- (e) Limitation of liability — Artist Roster is not liable for any claims, damages, or disputes arising from your use of the Import from Website feature, including but not limited to intellectual property infringement claims, violations of third-party terms of service, or unauthorized use of third-party content. You agree to indemnify Artist Roster against any such claims as set forth in Section 19.
- (f) Service limitations — The Import from Website feature is provided on an “as is” basis. Artist Roster does not guarantee that the tool will successfully retrieve content from any given URL, that retrieved content will be complete or accurate, or that the feature will be available at all times.
11. Disclaimer
- Artist Roster is a discovery and visibility platform. We do not guarantee sales, gallery representation, commissions, or any specific outcomes from using the Services.
- We do not vet, endorse, or guarantee the legitimacy of buyers, curators, galleries, or organizations using the platform. You are responsible for conducting your own due diligence before entering into any transactions or agreements with other users.
- Artist Roster is not a party to any transactions between users. Any agreements, sales, or commissions are solely between the parties involved.
12. Accounts & Registration
- You may need to create an account to access certain Services.
- You are responsible for maintaining the confidentiality of your login credentials.
- You agree to provide accurate, complete, and current information when registering.
13. SMS / Messaging Services
Program Description: By opting into Artist Roster's SMS program, you will receive notifications about new opportunities, profile activity, and platform updates relevant to your artist profile.
- You can cancel the SMS service at any time. Just text “STOP” to the short code. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
- If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at support@theartistroster.com.
- Carriers are not liable for delayed or undelivered messages.
- Message and data rates may apply for any messages sent to you from us and to us from you. You will receive up to 8 messages per month. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

14. Payment & Subscriptions
- Some Services are free; others require a paid subscription.
- Prices and features will be clearly disclosed before purchase.
- Subscriptions automatically renew unless canceled. You may cancel at any time before the renewal date.
- Payments are processed by third-party providers (e.g., Stripe). We do not store your full payment details.
15. Privacy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your data. By using our Services, you consent to our privacy practices.
16. User Conduct
You agree not to:
- Use Artist Roster for unlawful purposes.
- Attempt to disrupt or interfere with the Services.
- Upload or import content that infringes on the intellectual property rights of others.
- Share, resell, or misuse Artist Roster's content without permission.
17. Intellectual Property
- All platform content, design, trademarks, and materials (excluding User Content) are our property or licensed to us.
- You may not reproduce, distribute, or create derivative works from platform content without prior written consent.
18. Disclaimers & Limitation of Liability
- The Services and content are provided “as is” without warranties of any kind, express or implied.
- We do not guarantee specific outcomes or results from using Artist Roster, including sales, exhibition opportunities, or gallery representation.
- You are solely responsible for any decisions, actions, or agreements you enter into through the platform. Artist Roster shall not be liable for any consequences resulting from interactions between users.
- To the fullest extent permitted by law, we disclaim all liability for any direct, indirect, incidental, consequential, special, or punitive damages arising from or related to your use of the Services.
19. Indemnification
You agree to indemnify and hold harmless Artist Roster, its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or connected to your use of the Services or your violation of these Terms.
20. Termination
We may suspend or terminate your access to the Services at any time if you violate these Terms. You may stop using Artist Roster at any time.
21. Governing Law
These Terms shall be governed by and construed in accordance with the laws of State of California, USA, without regard to its conflicts of law principles.
22. Changes to Terms
We may update these Terms from time to time. Updates will be posted with a new “Last Updated” date. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
